HM Land Registry issue first update to Practice Guide 40(s4) in over five years.

The update follows the recent Court of Appeal decision in White v Alder [2025] EWCA Civ 392. The guidance now refers to that case.

Its important that when obtaining Boundary Advice and Guidance that your Surveyor is up-to-date on the historic and most recent legal case law, even though a Surveyor will not be giving 'Legal Advice' in the direct sense. HM Land Registry Practice Guide 40 is also central to how to deal with Boundary matters.
