Expert Witness

What do we offer through our role as an Expert Witness?

Mark Pearce can offer over 30 years of experience and extensive knowledge from his postion as a Chartered Surveyor, and brings that to the role of being an Expert Witness, and producing reports under the requirements of CPR Part 35, Court Procedure Rules required by the Civil Courts.

Mark underwent the RICS Accredited Expert Witness Training in 2014, obtaining an Advanced Professional Award in Expert Witness Evidence.  Mark has produced hundreds of Expert Witness Part 35 Reports, both as party-appointed expert, for claimants and defendants; and as single-joint expert.  Mark has also made appearances to present Expert Evidence in the County Courts.

To prepare CPR Part 35 Expert Witness Reports needs a high level of expertise in the relevant field, for Mark these areas are Housing Disrepair Claims, Building Work DisputesBoundary Disputes, and Building Defects (where not correctly reported by other Surveyors in pre-purchase surveys). Mark's expertise would also extend to matters within the Party Wall etc Act 1996, although as yet CPR Part 35 Reports have yet to be needed in that area.

Chartered Surveyor

I needed some plans drawn up for submission to Land Registry for the potential sale of some of my land to a neighbour. [Smart Surveyor] supplied these (without requiring a site visit) in just over two weeks after I sent my request. Very happy
