CONSUMER CONTRACTS (INFORMATION, CANCELLATION AND ADDITIONAL CHARGES) REGULATIONS 2013

Where PBSC enters into a contract with a client who is a ‘Consumer’ (as defined by the Regulations), the contract may be covered by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.  These regulations set out certain information that we must provide to you and sets out your rights to cancel the contract within 14-days.

The information we give here applies ONLY to “Distance Contracts”.  This primarily means contracts entered into by email, telephone and/or post.  It does not apply to contracts where a client visits our office.

 

  1. The main characteristics of the services that we will provide will be set out in an email or letter (or both) at the time of giving a quotation.

  2. The service will be provided by PBSC (the trading name of Pearce Building Surveying & Consultancy Ltd).

  8. Where possible the total price of the service will be stated inclusive of taxes in a quotation, set out in an email or letter (or both).  If the total price cannot reasonably be calculated in advance then the manner in which the price is to be calculated will be stated.

  9. Where possible the cost of additional delivery charges and any other costs will be set out with the quotation.  If the additional charges or costs cannot reasonably be calculated in advance then we advise here that additional charges may be payable.  In the case of disbursements (expenses/payments made to to others) these will be re-charged with 20% in addition to the amount paid and that calculated figure is subject to VAT in addition.

  10. Contracts of an indeterminate duration will be billed as a proportion of the service undertaken and billed at intervals as set out in our terms of engagement provided.

  11. The costs to you (such as call charges or data charges) of using the means of communication with us are those charged to you by your service provider calling UK code 01494. We do not operate ‘premium’ rate lines or profit from any means of communication.

  12. The arrangements for payment, delivery and performance including the time by which we will perform the services will generally be set out in the conditions of engagement that we provide or set out in an email or letter (or both).

  14. If there is a right to cancel the contract under the Regulations, then the conditions, time limits and procedures for exercising that right must be executed in accordance with paragraphs 27 to 38 of the Regulations.

  15. Where applicable in case of cancellation by the consumer the client will have to bear the cost of returning any documents already supplied.

  16. That if a client, or their representative, expressly requests us to commence supply of the service within the cancellation period then they must send to us instruction to do so.  An appropriate document to send to us can be found here <CCW>

  17. If having expressly requested us to commence supply within the cancellation period then the client will loose the right to cancel the contract, under the Regulations, if we have already fully performed the service; or we have already supplied digital content not on tangible material; or if we have not fully performed the service, then the client must pay an amount for the supply of the service for the period for which it is supplied.

  18. We do not enter into ‘sales contracts’ for the purposes of these Regulations.

  19. After-sale assistance, after-sale services and commercial guarantees are not applicable to our services for the purposes of these Regulations.

  20. RICS can provide copies of codes of conduct applicable to us as Chartered Surveyors.  These are available here <Code of Conduct for Firms>.

  21. The duration of the contract is until such time as the performance of the service has been completed (or relevant stage, where applicable).

  22. Where minimum fees or minimum chargeable hours are applicable these will be set out in an email or letter (or both) at the time of giving a quotation.

  23. Deposits or other financial guarantees to be paid or provided by the consumer are not applicable to our services for the purposes of these Regulations.

  24. Where applicable the functionality of digital content will be provided with the quotation.

  25. Where applicable the relevant compatibility information of digital content will be provided with the quotation.
